Welcome to VANDOMA LIVING SUITES,

Before using our services, we ask you to carefully read these Terms and Conditions which set out the rules that apply to the services we make available (hereinafter referred to as the "Services") through our website https://www.vandomalivingsuites.com/pt  (hereinafter referred to as the "Website") and our booking engine, https://booking.roomraccoon.pt/viserion-lda/pt, incorporated into the website and which allows the booking of reservations (together referred to as the "Platform").  



These Terms and Conditions constitute a legally binding agreement entered into between you, as a Client using the Platform, and VANDOMA LIVING SUITES, the entity responsible for the Platform, and which you can contact whenever you wish, using the contacts we provide in the Contacts section. 



These Terms and Conditions may also be complemented, in everything that is not provided for herein, by the specific conditions that may be established with you individually, by our Privacy and Cookies Policy, which can be accessed here



In order to better describe the Services that we are committed to providing and to ensure that we are able to properly convey to you everything that you have at your disposal, as a user of the Platform, we believe it is essential to establish and explain to you the main concepts and definitions that we will use throughout this text. 



However, if after reading all the information we have made available to you, you still have any questions or doubts, do not hesitate to contact us.



When we refer to "we", "us", "our" or "VANDOMA LIVING SUITES", we refer to VISERION, LDA., a private limited liability company registered in the Portuguese Commercial Registry Office under the legal person identification number 516.506.277, with registered office at Rua do Passeio Alegre, n.º 264, 3.º Direito, 4150-571 Porto, parish of Aldoar, Foz do Douro and Nevogilde, municipality and district of Porto. 



When we refer to "you" or "your", we mean you, the person using our Services, through our Platform. 



CONCEPTS AND DEFINITIONS


Except when the context in which the word is used gives a manifestly opposite meaning, whenever in this document the terms and expressions specified below are used with a capital letter, regardless of whether they are used in the singular or in the plural, they will have the following meaning:



Platform: provision of our Website https://www.vandomalivingsuites.com/pt  and our Booking Engine, https://booking.roomraccoon.pt/viserion-lda/pt/, for the purposes of registration and Account creation and reservations/acquisition of the Services. 


Website: the VANDOMA LIVING SUITES website available at https://www.vandomalivingsuites.com/pt, where the Client can access the Platform.


Booking Engine: the website incorporated into the VANDOMA LIVING SUITES Website, available at https://booking.roomraccoon.pt/viserion-lda/pt/, which allows you to make reservations and manage them.  



Client/Guest: any natural or legal person, with full legal capacity to promote and/or enter into contracts, in accordance with Portuguese law, and who uses our Platform;


Account: profile to be created by the Client in order to access and be able to use the Platform.

Service(s): the accommodation services that we undertake to provide under this Terms and Conditions, expressly requested by the Client, by booking a reservation via the Platform. 


T&C: these Terms and Conditions of use of the Services.


Registration: the process of creating an Account by the Client, which involves providing their data and accepting these Terms and Conditions, as well as the Privacy and Cookies Policy, with a view to making a reservation on the Platform. 


Accommodation: Apartment/property selected by the Client, for the purpose of making a Reservation. 

Reservation: process of selecting Accommodation, for a certain period of time, through the act of Registration. 


Direct Booking: Booking made directly through the Platform.

Indirect Booking: Booking made through other operators, namely Booking.com, Airbnb, Hoteis.com, C-Trip, among others.


Stay: period of time selected by the Client to enjoy the Services. 



ACCEPTANCE OF THESE TERMS AND CONDITIONS


By completing your Registration process with VANDOMA LIVING SUITES, you are declaring that you have read, understood and accept our Terms and Conditions for the use of the Platform. Please note that your use of our Services and Platform is subject to your full acceptance of these Terms and Conditions, so if you do not agree with these Terms, please do not complete your Registration process.


By accepting these Terms and Conditions you will be assuming a set of responsibilities and obligations.  


SERVICES


VANDOMA LIVING SUITES offers Accommodation Services in modern and equipped apartments, located in the center of the City of Porto, in Portugal. 



Services offered include:

  • Short and mid-term Accommodation: Fully furnished, ready-to-move-in apartments for flexible stays.

  • Amenities: All apartments include free Wi-Fi, an equipped kitchen, comfortable seating areas, daily cleaning services.

  • Online Reservation Management: Clients can check the availability of apartments, check prices and make reservations directly through the Platform.

  • Customer Service: Staff available to provide assistance and support during and after the stay, accessible via email, phone or Whatsapp.

  • Outdoor swimming pool: Clients can use thee outdoor swimming pool form 09:00h to 19:00h and must respect the rules set out in these Terms and Conditions, in particular respecting the resting hours of other guests. Children under 18 are not allowed to use the pool without an adult supervision. The pool is not guarded.  



VANDOMA LIVING SUITES is at the disposal of Guests during their stay, and afterwards, to respond to their complaints, resolve any faults and allow them to fully enjoy their stay. Please note that the longer it takes to submit your complaints, the more difficult it will be for us to settle your claim in your best interests. Please specify in your message the name of the reservation holder, the reservation number and dates of stay, as well as the type of apartment booked, in order to facilitate the processing of your case.



RESERVATIONS


Accommodation reservations can be made on the Platform (Direct Booking), through the Website, which will refer the Client to the Booking Engine, through email or phone (Direct Booking), after the acceptance of a proposal, or they can be made indirectly (Indirect Booking), through other operators, namely Booking.comHoteis.com, Airbnb, among others, which operate independently, with their own conditions. 



For all intents and purposes, these T&C apply to Direct Bookings, and in this sense we will collect and process some of your personal data, as provided for in the Privacy and Cookies Policy, available here.  Therefore, in case of making Indirect Reservations, i.e., through other operators, we alert the Client of the fact of being subject to those operators’ terms and conditions, and possible policies applicable by these operators, namely the Privacy Policy.


At the time of making your Reservation, you will need to present a valid credit card.


After confirming the Reservation, the Client will receive an email confirming all the details of their stay (reservation number, arrival and departure date, number of guests and rooms, and the advance payment, if applicable to the reservation). Then, as the check-in date approaches, the Client will receive an e-mail to check in online.



VANDOMA LIVING SUITES reserves the right to cancel or modify a Reservation in the event of an availability error.


In the rare and unexpected event that we are unable to provide the previously confirmed accommodation, we assume the responsibility of transferring the Client to an alternative accommodation of the same or higher level, at no additional cost to the Client. If there is no accommodation of equal or higher quality than the original booking, or if you do not accept the alternative we offer, we will refund the full amount paid through the booking. The transfer of the Client to an alternative accommodation or the refund of the amount paid in the reservation, determines the exclusion of any other obligation of VANDOMA LIVING SUITES towards the Client.



PRICES AND PAYMENTS 


All prices displayed on our Website are in euros (€) and include VAT (the general sales tax in Portugal).  If VAT rates change, we reserve the right to change our prices accordingly. 

Payment can be made using the methods available at the time of booking, namely credit or debit card, VISA, Maestro, Amercian Express or Mastercard. 

Any additional fees, such as optional services or local tourist taxes, are not included in the price, and are borne by the Client, and this information is clearly indicated before payment confirmation.


Currently, the tourist tax in the municipality of Porto is €3.00 (three euros) per person, per night, up to a maximum of 7 consecutive nights.



CANCELLATION POLICY AND REFUNDS 


The Client may cancel or change, free of charge, up to 7 days before 12:00 on the first day of the stay, their Reservation. However, there are certain specific rates that are subject to their own cancellation policies, applicable at the time of the Reservation. If your rate is non-refundable, there will be no refund of the prepaid amount. In case of no-show under the terms of the Reservation, the total amount of the stay will be charged. 


Exceptional regimes:

  • For bookings with a check-in date between April 1st and October 31st and from December 27th to January 3rd: free cancellation up to 14 days before the check-in date. In case of no-show or late cancellation, the total amount of the reservation will be charged;

  • For bookings with a check-in date between November 1st and December 26th and from January 4th to March 31st: free cancellation up to 7 days before the check-in date. In case of no-show or late cancellation, the total amount of the reservation will be charged.



DEPOSIT POLICY: 

To secure the reservation or cover any damages during the stay, a security deposit may be required, the amount of which will be advised at the time of booking. This deposit will be temporarily held on the credit card or requested via bank transfer prior to check-in. The amount will be refunded in full within 5 working days, after checking the condition of the Accommodation and confirming that there have been no damages or violations of the rules of conduct. If damage or infractions are identified, the corresponding amount will be deducted from the deposit.



CHECK-IN AND CHECK-OUT TIMES:


We kindly ask you to provide us with your best estimation of your arrival time, in a timely manner. 


Check-in can be done either in person or automatically: 

  • Check-in: from 16:00h onwards.

  • If Guests arrive before 16:00h, we will do our best to store their luggage until they enter the Accommodation, but we cannot be held responsible for any loss or damage. 


Check-out must be done by 11:00h. 


RULES OF CONDUCT 


By using the services of VANDOMA LIVING SUITES, the Guest undertakes to use the Accommodation responsibly, in accordance with its purpose, and always respecting the other Guests, the property, and the rules of conduct set forth herein. 


The Guest undertakes, from now on, not to carry out illegal activities or activities that may cause damage to the property.


To ensure a pleasant stay for all VANDOMA LIVING SUITES Guests, it is necessary to comply with the rules of conduct set forth herein, and other common-sense rules, namely: 

  • Respect for Silence: Guests must keep the noise level low, especially between 21:00h and 07:00h, in order to respect the rest of other Guests and neighbors.

  • Proper Use of Facilities: All equipment and facilities made available in the Accommodations (furniture, appliances, kitchen utensils, etc.) must be used correctly and treated with care. Damage or breakage caused by misuse will be charged to the Guest.

  • No Smoking: Smoking is strictly prohibited inside the Accommodations and in the enclosed common areas. Guests who do not comply with this rule may be subject to an additional cleaning fee.

  • Pets: Although we appreciate the good experience that pets bring to each space, unfortunately, they are not allowed in our Accommodations. 

  • Maximum Permitted Occupancy: due to the specific characteristics and configuration of our Accommodations, we do not have the capacity to have extra beds. Each apartment has a defined maximum capacity, and the number of Guests cannot exceed the number indicated in the reservation. Our Accommodations have been carefully designed to ensure comfort, safety, and an optimized experience for all Guests. 

  • Security and Access Care: The Guest must ensure that all doors and windows of the Accommodation are closed and locked when leaving, to prevent theft or other incidents. VANDOMA LIVING SUITES is not responsible for belongings left on site.

  • Prohibition of Parties and Events: It is not allowed to hold parties or events inside the Accommodations, or in the courtyard of the same, unless this has been previously authorized by VANDOMA LIVING SUITES.

  • Use of Illegal Substances: The use, possession or trade of illegal substances within the premises of VANDOMA LIVING SUITES is prohibited. Any illicit activity will result in reporting to the authorities and immediate expulsion.

  • Respect for the Environment: We ask Guests to make conscious use of resources, such as water and electricity, and to collaborate with the separation of garbage, in accordance with national and municipal recycling obligations.

  • Problem Reporting: Any technical failure, malfunction or damage to the apartment must be reported immediately to the VANDOMA LIVING SUITES team so that the problem can be solved quickly.

  • Check-in and Check-out: Check-in and check-out times must be respected. If the Guest needs a different schedule, they must contact VANDOMA LIVING SUITES in advance to check availability. Failure to comply with the schedule may result in additional charges.

  • Responsibility for Personal Effects: VANDOMA LIVING SUITES is not responsible for objects lost or stolen on its premises. We recommend that Guests keep their valuables safe.

  • Liability for Damages: The Guest will be responsible for any damage or injury caused to the Accommodation or the common areas. In the event of damage, VANDOMA LIVING SUITES reserves the right to charge the amount corresponding to the repair or replacement of the affected goods.

  • Third-Party Visits: The entry of third parties that are not included in the reservation must be previously authorized by VANDOMA LIVING SUITES.

  • General Conduct: The Guest must act with respect and consideration towards staff, other Guests and neighbors. Any aggressive, offensive or inappropriate behavior will be grounds for immediate expulsion without the right to refund.

The Guest acknowledges that compliance with these rules of conduct is essential to ensure a pleasant stay for all VANDOMA LIVING SUITES Guests and will therefore fully respect them. Failure to comply with such rules is considered a breach of contract, and may result in penalties, fines or even the early termination of the Stay. 


REPLACEMENT OF TOWELS AND BED LINEN: 


In order to reduce the environmental impact of our operations, namely water and energy consumption and the use of detergents, we kindly ask our Guests to inform us, please, whenever they wish to replace bath towels and bed linen.



VANDOMA LIVING SUITES ACCOMMODATION ACCESS POLICY


In addition to daily cleaning services, VANDOMA LIVING SUITES staff, or maintenance team, may need to access your apartment to troubleshoot issues related to the maintenance of the apartment and its equipment, carry out checks, or follow up on any complaints. 


In such cases, we will do our best to inform the Guest in advance of the date and time when access will occur.


LIMITATION OF LIABILITY 


VANDOMA LIVING SUITES is not responsible for any loss or damage caused by factors beyond its control, including, but not limited to, force majeure situations, technical failures or acts of third parties. VANDOMA LIVING SUITES will make every effort to ensure that the Services are always available and in compliance with the advertised standards. 


VANDOMA LIVING SUITES will not be liable for any failure to comply with the obligations arising from these Terms and Conditions caused by an event beyond our control.


An event beyond our control means any act or event beyond our reasonable control, including, without limitation, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, strikes or industrial action by a third party, terrorist attack or threat of terrorist attack, war or threat of war, civil unrest, riot, invasion or failure of public or private telecommunications networks.


VANDOMA LIVING SUITES reserves the right to modify, at any time, the information contained on its Website for online reservations, being the sole owner of its content.


RIGHT OF TERMINATION OF THE CONTRACT


VANDOMA LIVING SUITES reserves the right to terminate this contract with the Guest and request their immediate departure from the Accommodation in the following circumstances:


  • Inappropriate behavior: If the Guest adopts behavior that endangers the safety, integrity or well-being of other Guests, staff, or compromises the proper functioning of the facilities. This includes abusive, aggressive or illegal behaviour.

  • Damage to property: If it is found that the Guest has caused material damage to the Accommodation, including its furniture, equipment or infrastructure. The Guest will be responsible for all costs of repairing or replacing the damaged goods.

  • Excess occupancy: If it is identified that the number of people occupying the Accommodation unit exceeds the maximum allowed limit. 


Termination of the contract under these conditions will result in the forfeiture of the right to a refund of any amounts paid, including the security deposit, where applicable.


PERSONAL DATA AND COOKIES


VANDOMA LIVING SUITES collects personal data from its Clients. All information regarding the processing of this data is described in the Privacy Policy and Cookies Policy, available here


INTELLECTUAL PROPERTY

All the content that integrates our Platform (texts, images, videos, graphics, sound, and all other available information), as well as its structure and layout, the selection, organization and presentation of its contents, including its functionalities and the software used, trademarks, logos and symbols that appear on the Platform are protected by intellectual property rights of VANDOMA LIVING SUITES or third parties that have been licensed to us. 


Access, viewing or downloading the content of the Platform by Clients must respect the intellectual property rights that protect such content. It is not allowed to transfer, disseminate, publish, make available to the public, modify, transform, copy, sell, use or distribute, in any way, the texts, images, or other information contained in the Platform or part of it without the prior written consent of VANDOMA LIVING SUITES. 


CHANGES TO TERMS AND CONDITIONS 


VANDOMA LIVING SUITES reserves the right to change or update these Terms and Conditions at any time. If such happens, you will be informed through the posting of such change, in a visible way, on the Platform. Changes will come into force within the period indicated by VANDOMA LIVING SUITES, which will not be less than 15 days from the publication of the change to the Terms and Conditions. 


 VANDOMA LIVING SUITES may amend the Terms and Conditions without observing the 15-day period referred to above, including with immediate effect in the event of:

  1. Be subject to a legal or regulatory obligation that prevents it from complying with the aforementioned 15-day deadline;

  2. Need, exceptionally, to amend the Terms and Conditions in order to address an unforeseen and immediate threat related to the protection of online service intermediation or protection of Customers from fraud, malware, spam, data breach or other cybersecurity threats.


If you do not accept the content of the changes to the Terms and Conditions, you must cancel your Account and not use the Services. 


FINAL PROVISIONS

If any provision of these Terms and Conditions is held to be illegal, invalid or unenforceable, in whole or in part, under any law, that provision or part thereof shall be deemed to be to that extent not forming part of these Terms and Conditions, and the legality, validity and enforceability of the remaining provisions shall not be affected. 


In such a case, the part of the provision that is illegal, invalid or unenforceable shall be replaced with a (part of a) provision that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect to the provision or its illegal, invalid or unenforceable part, taking into account the content and purpose of these Terms and Conditions.

GOVERNING LAW

These Terms and Conditions are governed by Portuguese law. Any dispute or claim related to the Services and the Platform, offered by VANDOMA LIVING SUITES, will be exclusively resolved by the Portuguese courts, more specifically by the Judicial Court of the District of Porto.
